                      DISMISSAL ORDER                
                                   
          On August 12, 1997, a Chair's Preliminary Ruling was issued
with respect to the above-captioned appeal.  The order provided that
MLP-97-05 be dismissed, unless written objections  and a request for
full Board review were filed on or before August 26, 1997.  Since no
party filed objections or requests for oral argument by this deadline,
this appeal is hereby dismissed.  Jurisdiction with regard to permit 
MLP #97-02 is returned to the Department of Environmental Conservation.
